Demand-Response (DR) programs for emergency generators require an Air Permit Modification?

Many companies have relied on demand response (DR) financial incentives by offering their emergency generators output to the electric grid during peak periods.

One year ago the court ruled that EPA had been “arbitrary and capricious” to allow backup generators to operate without emissions controls for up to 100-hour per year. EPA had until May 1 of this year to develop interim standards. Nonetheless, the day has come and gone and EPA does not have any interim standard.

The 100-hour rule is no longer in effect.

Facilities that may be participating, or considering future participation, in demand response using emergency generator should review their options carefully. The DR program options are still available if the generator is non-emergency and is permitted as such.
